Even worse is that they didn't prosecute Sandy Berger, who can't account for several classified documents related to the millenium bomber case. Those documents were after-action reports, that would be invaluable for terrorist groups. The common explanation is that he shredded them, but since he can't provide evidence of that, I think we need to consider that he may have sold or given them to terrorist organizations.
Yet he walks free, with access to the highest levels of government.
