WHOA BILLY!!!!! You"re taking bits and pieces of NYS law. Lets simplify things. If you live in NYS and find someone trespassing about all you can legally do is try and ID them. You can not legally hold them or prevent them from leaving. Trespass is a Violation, the lowest class of offense, it"s not even a crime. Just try and ID the person, WITHOUT DISPLAYING OR SHOOTING ANY GUNS, and their vehicle if any. If you have a camera, fine, get pics. Then call your local police. If you want to try the citizens arrest thing you b etter have a good atty on retainer. Also make sure your land is LEGALLY posted. If you want to try and keep someone from leaving, fine. But you may end up in the crapper too. Better to just ID them and make a Deposition later. Do not chase them dowm the road and try and run them off like one genius did a while back. Don"t hold them at gun point, save that for the home invasion. For Gods sake don"t shoot at them or try and shoot there tires. Be advised trying to run you down with an ATV is NOT grounds to open fire! Better to just use your head than end up in the crap boys.
