You have to be careful with your interpretation of a private club. If the club has paid employees, noone can smoke there. A friend of mine is an inspector for the state and he`s won court cases against "private clubs" who ignore the ban. That being said, I don`t necessarily endorse the law, I figure if a person has trouble with smokers in a club or a bar they shouldn`t work or visit there.
You can smoke at casions in NYS because they are owned by Indians and the Indians don`t obey laws. Check the US Supreme Court docket if you want to disagree with me on that.
