It's already that way in AZ. AZ owns all surface water, doesn't matter if it's run off or a stream or snow pack.
It's illegal to "trap" or "contain" any water in AZ without a State permit.
The indians are trying to get all water rights to water wells. I now have to file a $20 fee for EACH type of use, domestic, stock pond, irrigation or other use. After drilling my domestic well I got a summonds for court from the Az indian tribes that I had to give to the AZ DEQ (AZ water controler). The State is going to defend the well owners on this one.
