"Innocent until proven guilty" is a common mis-statement of the correct phrase- "Presumed innocent until proven guilty". If a person is shot, the shooter is guilty of shooting him from the instant it happens- but the presumption of innocence (the "golden thread which runs through our jurisprudence", according to Rumpole) applies until the guilt is proven. We are entitled to look at circumstantial evidence to prove guilt, and the analysis of such evidence would be the same, whether the perpetrator is alive or dead.
