You probably do have a good claim, but it will depend on the law of the state where you bought it. I assume the dealer told you he serviced it, so he may have internal records. If he serviced it, he saw the patch. It is highly unlikely that you have waived the implied warranty that most state laws provide for. You need to consult with an attorney who is knowledgeable about commercial/consumer issues. (Yes, I am and have been an attorney who has practiced in that area for more than 30 years.)
