Just off the cuff, you may have some grounds to recover. The uniform commercial code may offer you some protection since you're dealing with the sale of goods. It allows for the right to inspect and then reject. Only because it doesnt meet your satisfaction, not necessarily because the seller misrepresented it. (The guy may simply not have known about the bad spot.) As others have said, you are absolutely going to have to get an attorney who is familiar with consumer law.
