There is some really big risks if you build one & then find out you needed a permit - they can claim it as a wetland, or fill it in & bill you, or require you to rebuild it & bill you for that. There are setbacks, and the dirt you dig up shouldn't be used for forming the banks but needs to be hauled away, and on and on.

I would guess that almost all of the USA 'requires' a permit; but some local & state agencies do not enforce those rules, while other states add quite a few extra restrictions.
