I'll give you the points about the bad apples but, at least in Wisconsin, the liability argument doesn't cut it. State law says that if you allow someone on your property for recreational purposes and DON'T charge them for it, you have NO liability if they are injured on your property. State courts have upheld the law clearly enough that no one even tries to sue in that situation.
