Not if he lives in Texas. The law here is, you can protect your property after dark with any force necessary. Needless to say, even repo men are at risk after dark. One was killed a few years ago and the guy was NOT prosecuted. The poor guy was trying to recover a car that was was not being paid for. I do agree with retreiving the property but take enough force with you to repel any assault he may attempt. For a fee I can and will get your tractor back.
