Double07, I think you're right about the insurance companies being to blame for rampant lawsuits, but for a different reason. I know several personal injury lawyers, and they all say that they would have much less business if the insurance companies would wise up and quit forcing everybody to "lawyer up". If you have an injury and make a claim, the insurance company will just "stone wall" you. Many times will not return phone calls, respond to letters, nothing. I suppose they're hoping you'll just give up and go away (and the fact that they do that indicates that they may be right, in many cases). But as soon as they get a letter from a lawyer, the figure the jig is up, and they start cooperating. In most cases they end up settling for a reasonable amount, and everyone comes out a winner- the victim, because he gets 2/3 of "something" which is far better than all of nothing. And the lawyer gets 1/3 of something which wouldn't have been available otherwise.
As far as the huge wins in court, that's usually due to the jury. Some landscaper guy got $248 Million for cancer supposedly caused by Round Up. I don't care if he fell over dead the first time he touched the stuff, a guy's life is not worth $248 million, even if he's the King of England.
