If the load comes loose or the trailer gets disconnected from the truck the first thing the DOT will do is look at what securement was used and was it proper. As long as every thing checks out there is not much the DOT can say about it coming loose.
Tickets and arrest are not always made at the scene especially if the other person is presumed to be at fault. Even if the securement was found at fault but it did not contribute to the accident they may not issue tickets for it.
With that said I do not feel that the chains in the picture are of size or grade to hold that tractor from coming loose in a bad accident. I do not buy it was not our fault because the hooks failed as the letter stated. Yes they failed; because they were not the proper size.
