If the trailer came new with the brakes on one axle it probly is a 4000 lbs rated trailer. The law requires some sort of brakes on one axle when rated above 3500 lbs. A naked TO30 is about 2850 lbs shipping weight A naked JD40 is about 2950 lbs shipping weight. Either way yes it would be safe to haul the tractor. Be sure you have the tongue weight right and some good tires on it or you may regret hauling but outside of that go for it. The reason they only use 1 axle brakes is to keep the railer from jack knifing. If it has both axles with brakes when you apply your brakes the trailer will lock down when empty and swing around on you. With one axle brakes the one with brakes will lock and the other axle will keep rolling, this will keep the trailer off of you.
