George, I knew a drunk who got away with it by not leaving!
This man, now deceased, had an extreme case of alcoholism, high tolerance for alcohol. One of those people that did handle his drinking well, as far as maintaining some level of acceptable behavior, but the amount he drank was life threatening!
One night he had really outdone himself, gone beyond his usual level, put his old ElCamino in the ditch on the way home.
This is how he told his story:
As drunk as he was, he was still able to think. He got out of the truck, sat down on the side of the road and waited. Sure enough the cops came, or someone called them.
They asked if he had been drinking...
"Oh yes, a LOT! But I knew I didn't need to be driving, so I asked this couple from the bar to help me get home. He was going to drive my truck and his wife was following in their car. But turns out he was just as drunk 'cause he drove my truck in the ditch. His wife stopped, picked him up and left me here with a wrecked truck!"
He must have been pretty convincing, the cop couldn't prove he was driving, so all he got was a PI instead of DUI.
BTW, they took a breathalizer test, decided something was wrong with the machine because it read so high.
Took him to the hospital to draw blood, the alcohol level was so high they wouldn't take him to jail, afraid he would go into DT's.
He spent the night in the hospital, they let him go that morning.
