Jim, personal responsibility is dead. Suing someone into poverty after your wife and kids are dead really doesn't help things IMO.
After NYS adopted the FMCSR enmass about a decade back, we started doing DOT checks on farm trucks. You should have heard the screaming! Oddly enough, the total junk soon disappeared off the road, the OOS trucks dwindled and we started seeing some common sense applied. It's not like thee trucks were getting Stickers after a level 1, but the brakes, lights, tires, etc were way better. Do a Level 3 and most would just drive away with maybe a fix-it ticket for a lug nut missing or a light out. It works for the most part.
