Dram shop laws in some states have penalties for serving 'obvious' drunks, civil damages for drunk drivers as contributors. Dram Shop insurance required for bar license, booze license. Problem was for some bars not serving customers for other reasons, federal civil rights lawsuits and the state laws had to be re written to be valid again-- and many just let old law be nullified by Federal case, no replacement. Proving that one bar caused all the grief is another problem- the drinker is much easier to blame since very rarely was the drinker held down and forced to imbibe by bartender. Iowa at one time had minimal bars and state booze shop had a list of problem drinkers, drunk driver that were to be refused sales, call to sheriff if attempted. Then the liquor by the drink laws passed, public bars instead of 'private' clubs (memberships at door $5.00/night), drunk lists not kept up, can't discriminate among drinkers and ID checks that failed couldn't be held for law enforcement officers- younger brother did get caught and ended up in detox/dry out Knoxville couple months. Police drunk checks at road side are used some states- Georgia noted to get school books paid for by share of drunk driving fines and when new text books needed a lot of road side barricades put up on the interstate ramps. Minor problem setting up inspections without probable cause, getting evidence in court sometimes. Wisconsin statute 946.40 subsection has the refuse blood test penalties- a former Demoncrat that was pulled out of ditch refused, didn't get the drunk charge but had about $1000.00 fine for obstructing- was the assistant state attorney(?) Lautenslager(?) under Doyle. Test positive but cooperate and can get payment schedule and traffic school, some community service instead of longer jail time and fine for criminal obstruction- know a guy that did a long weekend in jail instead of 3 months because he did quick 'guilty officer' take me to cell, time served and 1 more day after preliminary, testing and schedule of payments, got occupational license couple weeks later- but had the random breath tests clause for next 6 months. Prohibition was tried and failed - so now were stuck with drunk drivers in public but state and federal excise taxes for whatever the politicians decide. MJ/Pot legalized for recreational use will have some more stoners on roads with bad depth perception, slow response- Nebraska police already watching the roads from Colorado and getting some smashed drivers, need jaws of life a couple times for crumpled vehicles.
