In the case of the junkyard, there are several "self-service" junkyards that I go to. At each one, I pay an admission fee and am required to sign a waiver regarding their liability for injuries. If I get cut on a sharp piece of metal, I KNOW that it is MY carelessness that caused it. If I trip over a rock, I still know that I should have watched more carefully where I was walking. And, the simple fact is that I was warned that I could get hurt, and I signed a waiver acknowledging that fact. That, however, does not relieve the junkyard of exercising due care in their operations. Negligence can still come into play. Like if their employee runs over me with a loader, that would be negligence on their part, and would likely void a waiver - IF NEGLIGENCE COULD BE PROVEN. These junkyards have been operating in this manner for a good long time, and as far as I know, the folks that patronize them are knowledgeable car people, and are grateful to have a place where they can actually get the parts that they need at highly discounted prices.
