I know a farmer that was checked while on his own property, he was using his truck to bring round bales to the barn on his own property and had put 5 gallon in the truck to keep from running out. They told his wife to either give them permission to check the vehicles or they would stay there until the sheriff showed up with a search warrant. The other second truck was legal.
Long story short they fought the fine and won, the truck was not on a public road and there was no proof it had been driven on public road with off road fuel. I know other farmers who have been checked in similar circumstances and paid the fine rather than fight it.
