The rules of the road as stated in almost every vehicle and traffic code book in the world: If you are moving FROM your lane of travel to pass, it is YOUR RESPONSIBILITY to determine whether you can safely complete the pass. The basic law states that if you are in the act of passing and a collision occurs, you are presumed at fault. It does not matter if the other operator signaled or not. The vehicle moving in the travel lane has the right of way to proceed as necessary. The overtaking driver is required by law to yield to the other vehicle. Frustrating as it may be, that is how an accident investigator will see it.
