I just read a report that was in the detroit free press, sounds like the old guy had passed them, apparently the victim did not like being passed and when they came to a stop light he got out and approached him, I would think weather or not he is charged will have to do with weather or not he was actually beating on the guy's window, or still approaching. Regardless, the outcome is very unfortunate.
