I don't know of any state that has outlawed MH axles. Some states have outlawed the MH and UTG hub/wheel/rim combination. Change the hubs to use traditional 6 or 8 lug wheels and the MH axles are still legal from what I've seen.
Plus it looks like MH hubs on older trailers were granfathered in, in some states. The issue is with using them if you're building a new trailer.
