A retirement community across the road from my farm diverted water from a couple large buildings they built into a small drain tile that ran under the road.It flooded my farm,had 3 acres I couldn't farm.The county had no power to do anything but talk.We hired a drainage lawyer that said they couldn't do that,but two years and 20000 bucks in legal fees later they convinced us to settle.They said if it went to court we would have to hire a trial lawyer and professional witness types to testify.They paid my legal fees and changed the water flow to a detention pond. The law can be interputed in many ways.The lawyer said we have to take water run off from the neighbors.We contended that they changed and increased the water flow by building and running the spouting water onto our property.It just depends on how much justice you can afford.
