If had just been in the drive he wouldn't have been trespassing if the drive is not posted or doesn't have a gate. He was on his roof. That's trespassing for one charge. Trying to run a con is also illegal. That's trying to defraud, that's the second charge. When the OP was able to tell the cop that the roof was new a couple of months ago the con man had made the attempt to defraud. So if the cop decides to haul the guy in to run him through the computer for possible other wants or warrants the cop was on firm legal ground. I don't know how long they can legally hold him in the OP's state but certainly long enough to run a check on him. If the prosecutor decides to actually charge the guy he can then be run in front of a judge to determine if there will be bail or not.
With the arrest the cops can impound the vehicle and have it towed too.
