First of all you are correct, there should be a statement of loss stating that repairs will be more than 75% of retail value or that car is structurably unsafe to repair at any cost. Also there is the settlement amount to be determined of which you need to bargain for top dollar. Don't forget to include all towing charges and a charge for vehicle you may have had to borrow to take the place of wrecked one to get to work etc.Once you agree on a price then you need to RECIEVE AND CASH their check and then and only then do you give them a signed off title. Any other sequence of events requested by them is totally unacceptable and unwise.
