YES the diverter is the problem. Some diverters are a handled between the hot and cold valves that is turned--that's not sealing the tub spout when turned to shower. Some are gate type valve in the spout--again not sealing and needs to be replaced. Which ever you have it a pain. Handle you'll have go in from the back side or bust through the tile. The gate type (pull handle in the spout) screw off the spount and replace then recaulk.
