From what I learned when I wanted to divert the stream that feeds my pond to improve my driveway. The Army Corp of Engineers now controls all waterways from the coast to their source. Without proper permits, you can't change or impede any creek, stream, river etc. Even those known as wet weather streams, meaning they only flow when it rains enough. Try building a pond now and see how many hoops you have to jump through. I hope I am wrong but in my opinion your neighbor has the gov't. on his side.
