When I built my home there was a specific clause in the building permit papers: "thou shall not disrupt the natural drainage flow of the water"
And.....If you are disrupting the natural drainage then it might be an issue. If your berms have been there for many years than he may not have a leg to stand on.
If this guy persues this then get an attorney. If the guy knowingly bought the land and it has water on it then it might be deemed as wetlands. "Hey buddy you bought water front property"
