I understand what you are saying, but you are wrong. If you rearend a vehicle that is operating legally you will almost always be found to be at fault. What if instead of a tractor it was a stopped school bus, or a rural mail carrier, or a garbage truck, or even just a normal car that is waiting on traffic to clear so that it can make a left turn? You were going too fast for conditions.

Did you know that you can get a speeding ticket when you are driving under the posted speed limit? You get it when you are driving too fast for conditions, ie fog, rain, etc.
