In Indiana if You hit someone in the back; It doesnt matter why! You owe them, & I think sometimes people do it on purpose to get insurance to pay for a vehicle thats well below normal value, & maybe some medical bills that will be greatly over inflated with things such as pain, & sufferage!
I pulled out of a parking space about 20 years ago, & backed into a parked black car in a non lighted parking lot. I hit it with an Chev. S-10 at a creep. 2 people in the car; I had witnesses they had no lights on well after dark parked perfectly accross my back end. Witnesses told police they couldnt have been hurt; 1 of them complained about neck, & back trouble. Ambulance takes them away. Eventually they soaked my insurance for over $30,000. Put about a 1/4 - 1/2 inch dent in their car door was all. I told their agent if I knew what they were going to do, I would have nailed them good (only after it was over)!!!
