No I mean if the law suit was brought without merrit. It's been clearly shown she has no legal right to that property before she filed suit and I would think you'd have a right to collect damages from that.
It's about the same way in AZ. We 100yr leased a piece of property from another water member for a new well site. He leased us that land in good faith then waited until we had $150,000 into the new finsihed well then filed a law suit to break the lease.
He's lost twice in court, been arrested twice for assult on our board members but yet again were back in court for the 3rd time. Apparently this time if we win we get his house and 10a and it'll be over with. The bad part is his wife is disabled mentaly and it don't sound like he's too far behind her.
Our biggest problem is our old attorney died and our new attorney likes money too well.
