If it binds up in 2-3-4-5, then you've got a broken shifter fork. It's not a big deal but the deck lid has to come off the transmission.
You didn't "get took." You bought a tractor at an auction as-is, where-is, no warranties expressed or implied. You pays your money, and you takes your chances.
People don't take equipment to sales like that if it's in perfect working order, and unless you have X-ray vision there's no way to know what's wrong until you take the tractor home and try to use it.
The trick to auctions is to pay only the money you'd be willing to wad up and set on fire.
