Luckily, here in the middle of Kansas, juries are not so quick to side with the "injured party", especially in a case where that party was doing something illegal. Wife was on such a jury and they sided with the person being sued. Afterward, the judge came in and said juries here generally have pretty good common sense and side with the defendant. Still it will cost you a lawyer's fee. I was on a jury that would have been similar, but the judge threw the case out on a technicality before it really got started.
