Homeowner shoots intruder

According to local TV outlet, used shotgun, culprit may loose some fingers, homeowner won"t face criminal charges.
Don"t know if culprit and his family will have the gall to press civil charges.

If someone breaks into my home I figure that they are there to harm me and will use whatever force necessary to prevent them from that. Being a little older if they so much as twitch or maybe even blink---well a man"s home is his castle and it shouldn"t be compromised.

I was really disappointed about 20 years ago when a local man was found guilty of a crime and went to prison for protecting his property from a man stealing gasoline from his vehicle. My theory is that once a thief, always a thief and we certainly don"t need anymore of them.
 
The crook may not have the "gall" to bring civil charges, but some do gooder, anti gun, civil lib, ACLU type, Yuppie, Saab or Volvo driving, alfalfa sprout eating, vegetarian, mamby pamby, pencil necked geek, progresive/abundant, tree hugging lawyer (sure as H___ NOT meeeeeeeee) would in a heartbeat...

Read both of the news reports.

Both reports stated "[b:654c4848f0][i:654c4848f0]He also has a felony burglary conviction in Texas[/i:654c4848f0][/b:654c4848f0]".

Probably left The Republic because of our <a href="http://en.wikipedia.org/wiki/Castle_doctrine">castle doctrine/law</a> adoption in <a href="http://www.capitol.state.tx.us/tlodocs/80R/billtext/html/SB00378F.htm">Texas</a>.

If he or his survivor(s) was concerned about his civil rights prior to his alleged intrusion, maybe he should have consulted an attorney for an interpretation of <a href="http://www.ammoland.com/2009/08/03/michigans-castle-doctrine-law-and-you/">Michigan's</a> castle/doctrine law.

I was fortunate enough that I didnt go to law school until in my forties AFTER I had a "real" life an as enginner and farmer and tractor dealer but I saw how many of those young kids got shaped and molded and changed during law school, some NOT for the better. Im sooooooo glad I didnt have to do it for a living.

Yep that is why I believe in Dead man tells no tales. So if some one got into my home he would stand about a 99% chance that he would never be able to tell what or how it happened
 
In a former life I was a banker.

Went to law school to become a banker with a law degree; bank paid my tuition as one of my employee benefits.

Law students were told by law faculty "We will change your beliefs; right or wrong does not matter".

After the bank was closed by the FDIC ( another bad four-letter word ), thankfully my days as a law student came to an end.

My reasoning is that I'm 60, I've never been in a fist fight in my life, and I'm too old to learn now.

I'm too much of a chicken to take an arse-whupping, so I'll just shoot the SOB and let the lawyers figure it out.
 
I'd be willing to bet if he gets broken into again he won't miss next time... Hope the SOB doesn't sue him this time.

Agreed. You can never be too careful when dealing with the criminal eliment.

A few years ago a retired farmer near Salina KS caught three poachers on his land. He pulled in to the field with his pickup and talked to them straight up and asked them to not hunt there anymore - according to the sworn testimony of two of the poachers he was very nice courteous about it. The third poacher didn't like it at all though and stabbed the farmer in the face.

I don’t see any point in wasting politeness on criminals, treat ‘em how they need to be treated.

According to the tv news he shot five! times. Let's hope the guy gets life or the homeowner could face retaliation. Doubt the shooter scared the intruder to the point he ant be back if he can. Five times... I think he better practice!
 
I have some cousins that would have gladly taken care of some law breakers in mid-November when they found them hunting on their clearly posted property.

One of our fine state representatives was sitting in the vehicle while his two buddies hunted the posted property. He is as guilty as they are in my book.

I"m not sure what is going to happen as the cousins called the game warden and told him they would press charges against the men.
 
Michigan does not have a strict "castle law".
You have to be in fear of death or great bodily harm for yourself or another. But this seems to be a pretty open-shut case.

In Michigan, suvivors of the shot culprit can sue the shooter in civil court. Can you say "OJ"?
A later news cast said he might loose some fingers, so some flaky lawyer might try to get someting out of this.
 
Culprit had a laundry list of felonies in Michigan and Texas. Deputies were investigating the hotel room he lived in. Apparently a whole bunch of property of questionable origin. Question being who'd he steal this from?
 
Im from Michigan and one of my best friends is a Washtenaw County Sheriff. He told me that most shots fired by the police miss 70% of the time and that most police shooting"s are with in 30 feet of the suspect. Shooting at paper or beer cans or even deer isn"t like having a shoot out with a suspect. You got to think how fast that your heart rate would be and the amount of adrenaline that would be going threw your veins. Makes it much harder to hold your aim steady. And I don"t see how the scum bag that broke in could sue and get anywhere with it. What would you do if you were on the jury. And heard why the scum bag got shot.
 
Had that been in Canada, homeowner would be in jail, facing attempted murder, illegal use of a firearm, unsafe storage of a firearm, and aggravated assault, while the perp would be in hospital, being fed, bandaged, free lawyer provided, and being waited on hand and foot by a social worker who hates men, and advised to sue for a lifetime of loss of employment by the Workers Compensation Board.
 
here that happens regularly, if a criminal is dumb enough to break in to a home while the homeowner is home, he's dead right there, as one guy told me, if he didnt have a gun when he broke in, he will when the cops come to drag him off

Hitting 30% in a real gun fight is good. My cop friends will tell you that the real reason they rope off a cop involved shooting scene so long is it takes forever to account for all the wild shots they make. I have shot pistols on the range with cops and its allways amazes a duffer like me how they drill paper, real is different.

Only in this case the offender will lose only a few fingers instead of his whole hand.
If he doesn't go to jail he will be eligible for SSI from now on.
 
Good for the home owner. I do beleive you have every right to protect yourself your loved ones and your property.I'd do the same in that situation if possible.

Actually, I think if you fear for your life the use of lethal force can be defended. It's just not going to be an open/shut case as it would in say... Texas.

I agree 100% Old. If he would have come in here at 2am he wouldn't be doing an interview with a tv station a couple days later. Thats for certain.
 
Judges and lawyers appreciate the criminals who keep the business coming in. The criminals support judges and lawyers who live on big salaries and work in fancy, marble clad buildings with private parking where the taxpayer pays the tab.

Rick kr, yeah, that's what I thought. Now, if he's convicted and goes to prison AGAIN, he'll get 3 squares, a warm bed and FREE health care for another 5 or 10 years (all on our dime here in Michigan). Then when he gets out, what are the possibilities that (in his mid-fifties) that he'll be "rehabilitated" and be able to get a job, stay out of trouble and learn to live like the rest of us within the laws of society? I'd say slim to none and slim left town.
