O/T Gasline right of way

Cons- they dont pick the rocks after they are done digging.
Pros- they pay you by the foot for damages

After a year or so you can hardly tell its there. And if you turn them down its no big deal, theyll just go around. Hope this helps, toby.
 
If you turn them down they use the eminate domain law and come though you anyhow.Make sure they fix any field tile they cut.You'll be picking up rocks for years after.It took about 5 years for my crops to get back to normal.They can also come back in and dig for connections later on if your neighbors want gas.It's like selling the ground,it's yours,but you can only farm it from then on.
 
eminent domain sounds government, the farm across the road denied them and they had to go around, maybe were getting confused because my expierence is with a private company. Have a great stand of alfalfa on the one line right now. my state doesnt allow home hook up to the line anyways. I should have been more clear between private and government, sorry, Toby.

I don't understand how they can use emanate domain since they are not a governmental entity and recent activities have shown that there are problems if the gov. uses it to buy property for private businesses.

I would just let them do it, get an appropriate price for the item as it were rented for the year or two.

Move on.
 
A 15 inch will be a main line. Make sure it is dep enough, ours only has 11 inches of cover in places. Top soil on one side and subsoil on other. Two years of damaged crops, one for the year of construction, and the second prorated out 5 years. If you are in an area that requires drainage make sure tiles are fixed and you are allowed tile to be placed inside of right of way for trouble spots. If a mud hole get startrd on top of the pipline it can be impossible to fix.
 
Have dealt with 2 utility companies and ROW on numerous (rented) farms. One was a power line, the MAJOR power distributor in the SE (quasi-government); they are an ABSOLUTE PIA. Other is Texas Gas; the company and their reps could not be nicer to deal with.
 
My late Aunt had a major line across her place. When she had timber cut, the loggers had to build a 3 or 4 foot high dirt bover the line. Pipeline Co. required that. Might better check if you can drive tractor across it.
 
Don't take their first offer, get everything in writing,limit them to one single purpose line in the easemement, after construction don't take their widths as gospel, measure it out yourself. 15" high pressure line, make them put 5' of cover over the pipe. Look down the road, and if your property has any other potential, put in clauses that will enhance the future.If they are a public company they can condemn, settle before court, 99% of the time they win.Don't let them fool you about future crop issues, they show for along time, mines been in 19 years and this year, can follow the pipe route in the crop.If your in a high water area, water will follow the pipe.
 
They did a 30 inch through me. Did a good job. Buried it deep, re-seeded and payed good.VERY GOOD.
I wish they needed another.

Local city put in 80 miles of gas line to hook up their city. They got a judge to just issue generic eminate domain for entire farms; they could plan as they built & just run the line anywhere they wanted through any of the farms. They never paid the tennents for crop damage. They never talked to any of the farmers that got lawyers, just went to court & got ok to do whatever they wanted. Payment to some of the land owners came 3-4 years after the fact, no interest.

Was very, very badly done.

Town newspaper never seemed to report on it much, if you weren't involved, you didn't hear much....

Guess it depends who you are.

from what i'v heard they pay well and don't re dig to often.As someone said only 11 inches under that sounds to close to surface for me so I would just make sure they put at least 3 ft over pipe,that way you can at least put in a fence pole
 
I'm glad at least one person knows the difference between eminent and eminate. I wouldn't want the wrong word to eminate from my fingertips.

If that was the case, and people didn't get paid, you fence the machinery in, charge them with trespass, and the fee will be $xxxx to get equipment out of storage.
 
My late Uncle retired in 1976 from The old Lone Star Gas Co, in TX as Vice Pres. of Transmissions. He was in charge of all pipe lines and Trucks. He had worked there for 40 years. Worked his way up from untaller to VP.
 
Judge basically wrote them a free pass to put the pipeline in, and everything will be fine afterwards. You'da been in jail if you had done that.

I agree with _you_ for sure, but just telling how it was. I wasn't involved, but know people who were.

I've had my own issues this summer with the phone co: my tile, their fiber optic, and the same deal. They refused to talk to me, got a lawyer & their lawyer basically said we were a gnat and they were a bird, go ahead if you want to push it.

Wrong, frustrating, and it shouldn't be that way. But - what can you do, by yourself? Ain't right, but hello world.

Their lawyers are paid to intimidate people and are good at what they do. Stand up to them, throws them off. Had issue this summer with a cell tower on my property, told me what I was going to do, when they were done, I said bring the cranes and get it off my property, amazing how reversing things gets their attention. Tower and all origonal terms are still in place.
 
Don't sign the first thing they give you. Ask a few folks who have bought or sold alot of ground the last few years and find out who they thing is the best real estate lawyer close to you have have them read/make corrections in everything before you sign up.

pipeline across our place has required maintenance 2 out of the last 4 years... last year they dug up the line almost all the way across our place. I'm glad they are taking good care of the line, but wish they would quit digging! As far as compensation, the right of way on our place was sold years ago, so we got nothing. They did pay a few dollars last year for surface damage, but was in no way worth having the place dug up for 3 weeks ...D
 
If they are not able to force you DON"T SELL THEM THE RIGHT AWAY. You are giving them effective ownership of that ground. For a little money now you will get a PIA forever.
Rural water came through here twenty five years ago and my grand dad signed them an easement. He said it only applied to ten feet of the public road. WRONG!!!! They came in two years ago and put in a 6" main across my best farm ground. I got nothing for it. They did it in the fall after harvest. I have had two tractors and the combine stuck in the trench since then. I want to add to the tile in the lower part of that same field. The tile guy told me it would cost an extra $7500 dollars because they have to hand dig around the water main. If they damage it then they have to pay all the repairs.
I will never sign any type of easement or right away.
 
Get at least 4.5 ft cov, make sure you have in writing that only one line is put down, any more they have to pay again and make sure that you have no risers or above ground piping on your land and MAKE SURE that you state that the line can only be used for what it says(gas)no oil or fiber cable. Try to get as much as you can per ft, the latest here in Tx for small lines are 100 dollars a ROD... Good luck
