THE NEW IOWA GUN LAW

TO ACQUIRE GUNS OR TO ACQUIRE A CWP PERMENT:
YOU DO NOT QUALIFY IF:

1. Must be 21 years of age
2. Addicted to Alcohol or Controlled Substance
3. Have a history of repeated acts of violence
4. Constitute a dander to any person as determined by the issuing Officer {CWP}
5. Have ever been convicted of any of {Chapter 708} code of Iowa
Domestic abuse
Hate crime
Assault on an Officer, Fire fighter, Health care provider
Setting spring traps
Hazing
Stalking
Mental Help
6. Annual permits to acquire Hand guns and long guns{ This not a permit to carry }
7. A person MUST take the CWP class, pass the written test, and qualify on pistol range,
And pass the CBC. {CRIMINAL BACKGOUND CHECK}
8. The Sheriff still has the right to reject any one for any reason, a permit to Acquire or a
Permit for a CWP that he feels is justified.

The New Law reads exactly the same but number 8. And that will read:
The Sheriff DOSE NOT have right to reject any one for any reason, other than 1 to 7 a permit to Acquire or a Permit for a CWP that he feels is justified.

I know what they are saying, but I don’t understand. WHY CHANGE IT

Why change it is easy. It would not hold up to a court challenge.

Saying the Sheriff can refuse a permit for any reason means he can refuse because a person is black, or Jewish, or short, or nnalert, or nnalert. Or because his grandfather didn't like your grandfather. None of which have anything to do with public safety, and many are illegal discrimination.

It's best to fix a flawed law before the state has to pay damages, legal fees, and court costs.
 
For some reason a very similar law has been upheld in New York for years. The average man can't get a CCW permit in New York City but a degerate like Howard Stern can.
 
There is another gun law that may have to be challenged in court. It requires anyone accused of domestic violence to give up all guns. Google Iowa "domestic violence" guns. Just signed last week.

Basically what they are saying is.......

If you are a law abiding citizen your rights will be curtailed somewhat cause we want you to jump through hoops to buy a firearm.

Crooks dont abide by the law(s) See how it is.
 
That's a change most pro-gun groups advocate for.

They just change Iowa from a "May Issue" state (where the Sheriff may issue a permit, if he feels like it) to a "Shall Issue" (where the permit must be issued, unless there is a specific circumstance described in the statute that says it shall not be issued).
 
Unless it's frivolous and unfounded, I see no reason why anyone accused of domestic violence SHOULD have access to firearms.

In Nebraska, the Purchase Permit (Not a CCW permit) requires the criminal background check and is good for three years. To renew it, they do the background check from the start each time.

And I have no problem with submitting to that.
 
My question is why should you have to get permits to purchase a gun or permits to carry?

Doesn't the 2A give us the "right to keep and bear arms". Doesn't say anything about the Gov't saying who can and can't buy or carry a firearm and when and where you can/can't carry it.
 
Simple change of section 8 (no comments from military about section 8s) removes unspecified discretion of law enforcement to deny permiits. Change means denial of permits/licenses will have a specified reason in law that can be disputed in court- court will probably uphold reason but if the records are off can mean a permit issued for cause with less hassle. Also protects law enforcement agency from discrimination suits- reason for denial is defined by statute. Have to check with brother if he still carries .25 I sold him years back or if his wife still carries derringer. RN.
 
I also heard the fee went from 5 bucks to 25 bucks and you have to requalify every 5 years. Not a big deal, never had troubles getting permits in my county anyway. I think they was after Johnson county where no one was issued a permit because of politics.

Armed we're called citizens, disarmed we're called subjects.
 
Glad I"m here. Background check and walkout the door with it. Put in my pocket and no problem.

because for instance in my county for about 30 years and over 2 sheriffs there were no permits issued and no reason needed or given now do you know why they are changing it.
 
Eric has it right. Iowa went from "may issue" to "shall issue". That's a good thing. I don't like my freedoms to depend on the whim of any elected official. The 2nd amendment is the original right to carry permit.
