cattle......flies........lawsuit.... geez!!!

had a local farmer stop by the shop yesterday, he has been up at the county courthouse watching the proceedings on a lawsuit. seems a local farmer that raises cattle (around 100 head) plus small grain farm, is getting sued by a lady across the street from the cattle farm. (she has horses) go figure. cattle operation is a 3rd or 4th generation, she is a newbie to the area that bought a farmette across the street. flies from the cattle farm are disrupting her horses. bunch of scientist types have testified on her behalf, all types of samples and traps for population and type counts. rumor mill is suspecting that the people eating tasty animals group is behind this and trying a different angle to shut down beef producers in the area. this is real scary. i'll see if i can find out more scoop and post it.
 
i love these people who want to live in the country, buy their little plot and then want to change the enviroment to make it more to their liking.

Hmmm.........Sounds like that lady needs an unfortunate accident to occur, like maybe all the horses accidently drank some radiator fluid.........Oops.

People that sue for stuff like that need to be dragged behind a truck. Especially when the cattle farmer was there for decades before her.
 
I would think a savvy lawyer would find some kind of "prior rights" statute on the books. That slicker with her high dollar ponies knew the cattle farm was there when she showed up. The prevailing conditions go with the territory. Best thing for her to do is move....or shut the hell up.
 
Unfortunately, the common law "coming to the nuisance" principle has been overturned in some jurisdictions and is no longer the law of the land in some (many?) (all?) states.

If she's getting financial backing she can bankrupt farmers whether or not she wins the suit. Unfortunately that's the tactic they use in this country.

I really wish the US would use the British tort model, where the loser pays the legal expenses of both parties. That would also put an end to lots of medical malpractice suits overnight.
 
My uncle bought his family farm from his uncle maybe 15 years ago. Moved from just East of Denver to near Fairbury Nebraska, so he could farm it. NOW, he has the nerve to complain about the hog operation to his West, as it is stinking up his place. He used to farm, quit farming for several decades, now back at it, you would think he would realize that certain operations create a smell...I guess he forgot! Greg

Doing so and eliminating contingency fees (as was done long ago in nearly all other industralized countries) would solve just about all of the problems associated with tort abuse in the US.

Unfortunately, the nnalert are in the hip pocket of the trial lawyers, so this will never happen unless and until the nnalert gain overwhelming majorities in both houses of congress while simultaneously occupying the white house.

sometimes horse people have a lot of money, way more than a farmer who has broke his back all his life. But the sad fact is when it comes to court and lawyers money might have a better chance. Its not fair
 
I'm gonna sell mine to a black church for a church camp when folks around here p!ss me off too much.
 
look into the laws and open a leagle gun range as close to the horse idiot as posible and go shooting every day and scare the ____ out of them
 
Your friend with the cattle farm needs to branch out a little. He could get himself a couple of the sorriest-looking, swayback, broke-down, toothless old stud horses he can find. He could put him and a couple of scraggly jacks in the pasture next to those show ponies.
 
That's a lot like building a housing addition near the end of a busy already existing airport runway, then suing because of the noise. Go figure.

I think when she can prove that her horsies never attract flies or produce manure it will be interesting news. This may come back to bite her like Dave2 was!
 
Not to be on the side of the Woman but a pint bottle of Permectin will take care of the Flies. I use it all the time and have very few flies on my farm. I also raise cattle. When I bought the place it was terrible flies everywhere. Any way its a lot cheaper than a Lawyer.

Can you explain that?? Our pastures/horses are polluted with flies every summer. I take care of the horses, but it'd be nice to be rid of the flies.

I had a neighbor when I first moved here that complained about everything (horses eating (chewing) too loud, chickens scratching in the dirt and getting grass on their fence, rooster crowing, etc. I put a light on a timer to come on a few minutes every hour so the rooster crowed all night. put a feeder as close to their window as legally possible for the horses, and put chicken, horse, and a mix of cow/pig sh!t from a couple other neighbors along the fence line so I could plant flowers (dam chickens didn't listen when I told em to churn the stuff up and kicked most of it through the fence).
They sold the house and I get along fine with the new neighbors.

county west of us has similar mess.
a family form CA. bought 1400 acres to build a dairy farm want to milk 4500 cows.
they meant ALL the epa state and fed laws to due so. a bunch of local weinie whiners hauled them to court for all kind of goofy things.
judge ruled the whiners couldn't prove any of the things they were saying to be true and told farmers go ahead build your dairy.
well whiners are trying to get thing jump started
and have vowed to keep fighting and are trying to get this back into court.
some think animal rights groups are behind this as lawyers for the whiners cost to much for the people causing the fuss
 
Hay 730 virgil, I have been following that " mega " dairy up near you . Interesting , as I used to farm 4 miles from there . Seems to me that who has the most $$ usually wins .I suspect they will be milking by fall. legal or not.
 
Don't know about PETA, but I bet dollars to a doghnut hole that the sierra club has a hand in it. There was a poultry farm around here that got shut down because a bunch of neigbors sued them with Sierra funded lawyers. They claimed flys as grounds for the lawsuit, forced a nice hard working family farm into bankruptcy them nice folks did.

(Part that never made the news was that the houses had been there for 6 years with out a word and the compaints started as soon as the farm was sold to a family with a dark tan, and started after at total clean out and there was not a bird or 10lbs of litter on the farm. Seirra folks knowing or not might as well have helped the bigots pack a gas soaked cross to their yard.)

What state is this? You can bet if it is a state controlled by the Dimwits, the state enviornmental agency is working behind the scenes, providing 'expert witnesses' paying a portion of the legal costs, etc., to fk over the cattle feeder.
 
Virgil, the CA family you talk about will most likely be someone like Lynda and Stewart Resnick and their Paramount Farms Corp. Check them out on Yahoo. Lets face it, 4500 dairy cows on 1400 acres means it will be a huge confined livestock feeding operation. The feed will not be grown on site. The oders and manure dust will be intense and hammer the neighbors. Weekly, on what was once probably was a small beef and small grain operation, hundreds of semi trucks will be hauling in feed and milk out, busting up the roads, making noise ect 24 hours a day. You can expect the place to employee illegal Menicans by the dozens, with their families they will number in the hundreds in your neighborhood. Expect the rates of crime and meth problems to skyrocket. The local hospitals will deliver lots of new US citicens and not get paid a dime for it. Your schools will get messed up big time. That CA family will never be a part of your community, they will stay living in Beverly Hills or Santa Barbra. Have it if you want.
