i'm hoping John T. sees this my wife Mrs 730 in on retirement disability. she is 61 and has been on disability since age 55. we have been told she can not get s.s.
until she is 62.
would you know what the reason is for this. i don't feel we were given given a reason as why she can't collect just the old run around.

Like Sid says, she isn't 62.

She is drawing SS disability, a secondary part of SS but she doesn't have too be 65 plus to collect benefits like a normal retirement. When you get disability SSA, it's like you turned 65yo that day, and that's what your benefits are based upon.

2yrs after your disability date, then you get Medicare.

At 65yo, SSA will probably switch her too normal retirement ( comes out of a different fund) from what I've been told, regardless of the retirement age requirement.

Can she get more if she files a new claim at 65? That's possible from what I here. This might be too her advantage as she was 55 when injured. Check into it. Call SSA or see a specialized attorney for disability SSA as that's very complex and not easy understood.

She should be able to draw SS disability..I have also been on Disability since 55 and am now 61 had a private disability policy and then had to apply for SS disability when approved then the private disability decreased so that between the two I get 60 percent of what I was making..which works out because there"s no income tax on it
 
Almost forgot a important part.

If she has a private pension fund, IRA's, KELO's, etc; she can also draw on that at 55yo.

If she didn't file for the private plans at 55yo, then she probably has lost that amount from 55yo to the date she files.

It's really important too file on all pension plans on the day you get injured. If you don't need them, then no harm is done. They will still make you wait 6mths before applying you too the pension rolls but they will back-pay too the date of injury. If you wait 6mths then file, then no back-pay for 6mths.

If you have been told by the authority then surely they would offer the reason?.If not , then I would pose the question.
 
As a retired Social Security claims representative, I think I can shed some light on your question although I may not have all the answers.
First,is she drawing SS disability (dib) or a private disability pension? If it's SS disability, she is already receiving the same amount as if she were on retirement (rib) at age 66; there will be no increase at age 66. (She was born after 1942 so her full retirement age is 66.)
If she is not receiving SS dib, she would have to prove she was disabled within the last 5 years before she went on private disability as there must be what is known as a current connection to the program in order to be insured for dib.

Let me expand my thoughts. This is a very short version as there's many, many, rules too follow.

DOI=Date of injury
WC= State workmen comp fund
SSA-DIS= SSA Disability Fund
SSA-RET= Normal SSA retirement funds
PPF= private pension funds, IRA's, 401's, etc
PID= private disability insurance

All the above are considered "private" insurance company's in a court of law.

WC is paid from the DOI. CAN be filed with-in 1yr that a known disability exist, using(Federal & State Laws). This will require more than one Doctors opinion of the disability of "can you work at any capacity" and "for how long each work day". If you can earn more than $500/mth at "any" job, then your your benefits will be reduced, most likely too zero, WC or SSA-DIS.

Can you be retrained with-in being cost effective for the insurance company ? A general rule, is if you had been at your profession longer than 25yrs OR 55yo or older, then NO you can not be retrained, and "can be" then considered for pension. This isn't written in "stone" and can change at there whim. A 3rd party is hired to rate your ability. Key here is, "are you in pain while trying all there testing". Doesn't matter what the tests are.

A unwritten rule, is WC will not bother you from the DOI for 6mths. There time that there giving you to "heal up". Take this time too see numerous Doctors of your OWN choosing. Pay cash upon each visit. Obtain a copy of that Doctor#1 chart notes. Take those chart notes of Doc#1 and give too Doc#2 BEFORE the exam begins. Repeat for other Doctors. It's not uncommon too see 20 Doctors before your considered for pension benefits from WC & SSA-DIS. If the Doctor gives you a report in your favor, "then" apply for reimbursement from the insurance company.

"ALL" State, Federal and Private Doctors, you will be video and audio taped at "ALL" times, from the time you get out of your car to the time you get back into your car, including hallways, waiting and exam rooms, elevators, AND can be extended too your home/private property. Do not forget about satellites. You gave your permission for this when you filed for a claim.

"ONLY", WC and SSA-DIS can be considered on your benefit amounts that WC or SSA-DIS pays you.

"All" PPF&PID can NOT be considered by WC or SSA-DIS for reduced benefits amounts. PPF & PID are separate funds but usually require you be to receiving SSA-DIS before paying out your pension benefits.

WC and SSA-DIS have unlimited funds to prove your not disabled.

Now you can see why I suggested a specialized attorney for WC & SSA-DIS as it's very complex.

Scott you pay into SS and medicare over your working years you are entitled to it because you payed for it not because you were just there and want it.
I didn't pay into SS and I don't get to draw it.

I am on disability at 59. From what I have been told. At 65 it will turn into S/S retirement and pay will be the same. Two year wait on any medical help from the day you get disabilty
 
I have 38 quarters in SS and will never flush anouther penny down that sewer. As a California 1937 Act employee I am exempt. I won't miss SS, I am a 3@50 safety employee. I am not saying that CalPers and my county retirement system dosen't have problems, but its is 100,000 times as secure as SS. Unlike SS, I paid my share, and unlike SS, there is actually a CalPers fund backing it up. I also will have 2 health cares for life, one from the Fire Dept I work at now and one from the Sheriff dept that I am disabled from. If medicare went away tomorrow I am fine. What I am mostly glad about is we all get to choose what we do for a living and get to experience the consiquences of those decisions.
