Question on self storage dilema need opinions

A freind runs a self storage. Not the little 8x8 metal ones he stores larger items cars, boats, campers etc. What wood happen if the owner failed to pay the bank (lien, note etc) and they forclosed on the car, camper etc? As he does not release the item untill paid for so as not to lose his his fee. I doubt the bank would pay the fee?? your thoughts?? By the way the small 8x8 metal ones if some one defaults they sell the contents usually at an auction. Could he do this with the larger items?
 
How would the bank know he has possession of the car, boat etc? I believe your freind is within his rights to refuse to release the item until his fees are paid, just like a repair shop would do if they had an unpaid repair bill.

I doubt that your freind could auction these items off for unpaid fees in the same way as he can do with 'contents' because cars, boats, etc have titles that must be transferred. There is probably a legal avenue to allow him to put a lien against the car boat etc and force a sale. That would require getting an attorney involved I think.
 
In Michigan a sheriff's sale is conducted to attempt to raise the moneies owed. I know as this happened when I tried to get a mechanic's lein on an ols Chev van after the storage bill had not been paid for seven years.

the bank or repo company will need to pay him any charges that are incurred in order to release the vehicle. once in a while we run across this here at the body shop. generally it is on a police tow impounded vehicle that has towing and storage charges against it. advise the repo company that they will need to sign the necessary documents to release the vehicle to them and that it is CASH only upon release. it is not unheard of for them to either give a bad check or delay payment anywhere up 1 year. cash up front or no vehicle. they will try and negotiate for a better price, stick to your guns, they will pay the bill.
 
A little OT, but this reminded me of a story.

We had a local mini-storage place where someone rented a couple of storage units. Paid in cash, gave a fake name, whatever else. Anyway, after a while when they didn't pay, the owner opened them up to find hundreds of old mattresses. It was cheaper for this scumbag to dump them off at the mini-storage vs. bringing them to a landfill. Then the owner was stuck with getting rid of them!
 
Mini storage auction would action off boxes or suit cases that were supoosedly never opened and they didn't know what was in them. Knew some people that paid $15 for a suit case. Had some worthless books in it and the suit case wasn't any good.
 
This is funny.....25 years ago a friend of mine worked as a maint. guy at a low rent apartment complex.

Well....The cops get a warrant to go into this black dudes apartment to look for cocaine (and they find it in his leather suit coat pockets) and as the cops are slapping the cuffs on this black guy the cops also told my friend to haul all his furniture/tv/and crap to the parking lot. The cops then put a sign on all the stuff that said "FREE"

Years ago as a former banker, had to pay whatever fees/charges were against the vehicle/equipment before taking possession.

Most times that was the only way the mechanic/shop recevored money for the work.

Agree that fees/charges should be paid in cash; be sure to give a cash receipt.

No matter what happens, don't turn it loose before you get paid.
 
If a self storage unit.. I would suggest rental is paid in advance.
The State Authority would surely regulate these units.
