Am I exempt

I can not follow the anhydrous tanks thread because it is so broken up.
But I sure get a good laugh when I read some of the replies.

private carrier and use for agriculture he does not need a Hazmat endorsement

I shoulda peeled them off (talking about placards)

farmers are exempt

Its pretty obvious some of you guys do not know haz mat regulations.
Some of you read the first line in a paragraph and then stop because you are satisfied with the answer.

Yes farmers are exempt; but that is only for tanks properly mounted; are used to carry product to the field within XX miles of the supplier.

Haz mat rules do not play by this I'm a private individual; I'm not a DOT licensed hauler stuff.

I did not read the anhydrous post but know in La. a farmer can get away with murder(not really).a farm plate lets a farmer skirt or skate on a lot of DOT rules! In La. if you have a farm plate you are not required to wear a seat belt within 5 miles of your farm.same thing with an off road vehicle,atv or whatever,it can be operated on state or parish roads legally if you have a farm plate on one of your vehicles and within 5 miles.a state trooper had me dead to rights on the no seatbelt thing then told me about the law.didnt give me a ticket cause I was too close to the farm
 
You are obviously a talented, well trained, and knowledgeable professional truck driver. I would like to know if any of the ytdot members have ever pulled a permitted over weight, over sized load through a scale and had a full on DOT inspection and passed. Its a big difference between that and hauling a couple of round bales.
 
Hauled a 500 bushel grain cart 600 miles at 45 mph , the difference is I called the real dot not barney and got the right permits to do it . The trouble is barney has actually never been through a port and never hauled more than an 8 foot aluminum fishing boat with his half ton pickup yet he thinks he knows everything. And yes I Have hauled all kinds equipment through ports Swathers with 16 foot stil attached through Idaho and Wyoming big balers big tractors potato equipment and yes barney I have been inspected
 
It is hard to understand where you coming from with this ytdot, no matter if someone posts something that's right or wrong about hauling, out comes Barney. I guess I'm not smart enough to understand where you are coming from. Sometimes words are worth a thousand pictures. Sorry if you are offended you. By the way I love " The Andy Griffith Show"

Dont consider myself ytdot and didnt comment on the broken up anhydrous thread, but yes I have hauled oversized, overweight permitted loads. For a number of years I had my truck leased to a company that specialized in that type of hauling
 
Its only a joke . You notice I never post him on real accidents that people post because that is not funny when someone actually could get killed or kill someone else
 
Most people don't understand federal DOT regulations and who they apply to. They only apply to employers, employees, or commercial vehicles which transport anything in interstate commerce. Basically if you transports goods, people or anything else across state lines for compensation. The catch on farming is if they are operating for compensation (this can be a grey area, depending on situation) States do have authority to regulate within their state, so DOT regs are not the only thing to worry about.

Local, county or state police are not in any way compelled to enforce federal regulations, same as a city police are not compelled to enforce county or state regs, they can and do often but they don't have to.
 
This is the one rule that so many do not understand. I've quit
trying to explain it. If your not conducting commerce those
rules do not apply. As you said states have their own rules so
it get murky sometimes.

And I've tried and tried to explain to you and others; even gave links to the laws to prove what I said is true; Even had our X resident DOT officer (Bret4207) look up the rules for us; and still you guys try to insist it does not apply to you.

I don't know how to put it any clearer than "Haz Mat rules apply to everyone"
Saying you are exempt from Haz Mat rules is like saying you do not need brakes because you are not conducting commerce.
