I was pulling onto a divided highway by way of a right turn lane with yield, at a four way intersection controlled by a light. There is another road that comes in from the other side. I could see a small car approaching the light coming down that road, and I could see that I had plenty of room to get onto the road before he could negotiate the turn and come up to where I would be, so I proceeded. Just as I was getting straightened out with the big road, I heard a very loud crash and see movement out of the corner of my eye. I looked and that little car had just run into me. He had to have gone just as fast as he could make that turn in order to come up with me. He was apparently determined to make me yield to him. He was a 16 year old on his way to a basketball game with an adult in one of three other cars that stopped. I called for the police who was completely sympathetic with me. The car was still drivable with the front fender hanging off. My truck got a little mud rubbed off from the front tire.
 
Your lucky if you do not get sighted for the accident or sued by the other drive/car owner.. Around here right/wrong, any truck with a company/farm name on the side is going to be sighted or sued at the very least. They always want to go after the deepest pockets.

Four years ago one of our semi trucks was setting at stop light waiting for the traffic to clear so he could make a left turn. A car hit the truck from behind. Smashing the left rear of the trailer. The other driver tried to say that the trailer's left rear turn signal was not working. The cop at the scene wrote our driver up because the light was not functioning after the wreck. Now remember that side was totally smashed. The car hit the trailer hard enough it blew out both tires and sheared the U-bolts off at the axle. The entire rear fender of the trailer was bent/broken. We had to go to court to prove the driver was not at fault. Cost us $3500 in legal fees and $2500 deductible on the insurance policy. The driver tried suing our insurance company after that for medical costs. It was proven that the driver of the car was going 60 MPH in a 45 MPH. That was the ONLY reason we won the case. If the car driver had been going the speed limit I expect that we would have lost the case. This was with two other witnesses to the wreck that claimed the turn signals where working.
 
I have read case law on some accidents where they don't always determine total fault or no fault but instead they might split the fault in percentage ( 50/50, 40/60, 20/80 ) etc. This means if you are sued, lets say for $200k and they determine you are at 30% fault you will be responsible to pay $60k.

One case I remember was when a city truck crossing the highway pulled out in front of a pickup killing the 18 y/o driver. The parents sued and the courts determined the city was 70% at fault. The kid that died shared liability due to speeding. There were more details involved but the parents won nearly 2 million in damages.
 

Well, only time will tell, but the officer took probably a good fifteen minutes in his car after gathering all the information, I assume writing up what happened. This was after at one point responding to the kid "Oh so you cut into the other lane", and then responding to the adult who was with the kids, "well I can see from the spilled fluid exactly where the impact took place", which was out of the intersection. The fellow that I work for told me the next day that the other insurance company had already called him to say that I had failed to yield. I knew that this was going to happen which was why I called for police. The other group wanted to just exchange information and then everyone leave, then all support the kid that tried to force me over.

In Michigan, the ticket includes a determination from 0 to 100%.
