OT no time for killing of young lady.

This happened in the town I live in. It?s a terrible tragedy made so much worse by this ignorant judge. I did not know anybody that is involved. But I do have loved ones that travel through this intersection everyday and it breaks my heart. I hope this judge never has to bury a child.

The judge is probably a boozer as well - I've seen it happen in other cases that way. In fact, I knew one of those judges. He used to drive out of the city to a neighbor's farm and get roaring drunk - and then drive back to the city!
 
That's not justice, but with his attitude, won't be long he'll be back in court. A shame he may hurt someone else in the process.
 
Drunk who killed my nephew got 6 to 25. We felt he got off far too easy. Prosecutor indicated that was about all they could ask for. He was 2x the legal limit, and a daily grass burner.
 
Sometimes it looks like decisions are made in cases like this so the judges and lawyers are guaranteed repeat business. The law enforcement is also wasted in other areas. A few years ago a friend of mine and his wife were almost killed by a drunk driver. The guy has a repeat offender that didn't have a license or insurance. The law enforcement was on the other side of town using all their resources on a seatbelt sting.
The drunk driver spent a couple of months in jail and was turned loose. My friends wife was left cripple and in a wheelchair.

I don't know how the law works in your state, but if that judge is elected he can be unseated. And if he's appointed, someone is responsible for that and can bear the results. This is why elections matter.

FWIW- the drunk that killed my sister got off with a fine and probation too. Only in the past few years have sentences gotten stiffer.
 
My old county was spending $60 million to build a new jail because the old one is filled to twice it's rated capacity. I feel that money would be better spent on improving public transportation: buses, late night taxi services, etc.
 
Paul, being up the road in Osceola, I saw this as well. Our society doesn't seem to value life as much as they do property. If that sorry punk had just stolen her car he'd have gotten jail for sure. Help find someone to run against that a$$wipe of a judge. gm
 
Probably figured it was easier and cheaper to convict him that way instead of putting some effort into it and get real justice.
 
30 years ago I'd have agree with it, calling it a real bad or unlucky accident.

15 years ago I might have said he deserved a year.

But TODAY that should be a MINIMUM five years. Today - you KNOW you're not supposed to be driving drunk. You've had it - and the consequences - drummed into your head since birth. (I don't think it gives the kids age, but he sounds like a kid - talking x-box etc.)

Probation? driving THAT drunk is reason enough to lock him up for SOME time. Driving at 90mph is another reason. KILLING a girl is yet another.

You stack them all together - driving 90mph many times over the limit drunk, and killing a girl... What more does a judge need????

I feel so sorry for her father, I'm not sure what I'd do in his place. But I can say that kid better move to the other side of the country if he knows what's good for him.
 
I feel so ashamed that this woman's family got no justice. I came thru the intersection the morning after and before the vehicles were moved or anything picked up. Seeing the amount of destruction and the car parts and personal items scattered over such a large area was gut wrenching. I will not soon forget it.
 
I have always said if you want to kill someone just run them over and get drunk. You will be out of jail before your sober.
 
I guess I'm crazy, but that boy would not get a wink of sleep looking for me over his shoulder day and night.
Me and him and a Louisville Slugger would "run into" each other on a dark night or 2,3,4, know what I mean? I'm sure I'd get more
time than he did, but you just don't hurt my family PERIOD. I'd ask for a jury trial and hope they're all family types.
 

In this county a driver had repeat drunk driving offenses. He may have been left crippled and in a wheel chair before his last wreck, or maybe it was in his last wreck he was left in a wheel chair, but at any rate in his last wreck he killed someone and was given jail time. Judge did not show him any mercy.

I wonder about the Alford Plea- that usually means something a bit off in case, something that could be appealed yet. The 90 mph speed- was that what a pursuing officer was doing? Milwaukee has a 'no high speed pursuit for traffic case unless officer has direct knowledge of felony' just to avoid the liability problems, prosecution problems of a officer involved, partial fault in prosecution. Not going to get judges decision explained because it is against the states judicial code- so let the media do some searching or get the judge in court where a superior judge can tell him to say something- or get to federal court. Too much old case law of drunks getting away with killing while driving, lots of political pressure NOT to charge and sentence for death during drunk driving- remember 'Lady Killer Kennedy?' and the THC advocates pushing for the decriminalization of MJ can be a hassle especially now when the politicians should be debating on a platform assembled over a manure spreader ( couple days back had the thread and picture). Maybe judge will face electors/voters, maybe driver will mess up and end up doing a few years hard time, maybe Angel of Death will put drivers name on the 'todays to do in' list. RN
 
I probably shouldn't be telling this, but it was long ago and far away: I had the satisfaction of dispensing a small portion of "justice" to a drunk driver. One night my wife, small daughter and I were returning home when a car came out of a side street, turned toward us and came into our lane. I swerved out of his way and avoided a head-on crash by inches. The other driver's responses in getting back into his lane were so slow that I immediately deduced that he was snockered.

I'm a very easy-going fella, slow to anger, but the idea that this guy had endangered my family enraged me. Just a few months earlier a drunk driver had barreled through a red light, injuring two of my wife's sisters. So I turned around and followed him home. He parked in his drive, as did I. I walked up to the car; the driver-side window was open about three inches. I grabbed the top of the window and pulled it, breaking it. I then gave the guy (who was so blistered he didn't even say anything) four or five good pops through the window, along with a few choice words.

When I got back to my home, which wasn't far away, I could hear the sound of cop cars and an ambulance headed in the direction of that guy's house.

Am I proud of my behavior? No. But I'm not especially ashamed of it either.
 
I understand there are countries where drunk driving is a capital offense........
 
Jerry, maybe you should be proud of your behavior. You probably did more to curb this a-holes drunk driving than any court AND unbeknownst to you , you more than likely SAVED someones life that may have been his next victim. Just too bad you had to be the parent , school administrator, cop and court all with a few well placed knuckle sandwiches, but someone out there should probably thank you but they don't know who they are. So "thank you" for them. RB
 
Similar accident in Green Bay Wisconsin about 10 years ago. Drunk in a Porsche Boxter in excess of 80 MPH took out a car with two waitresses just getting off shift from a Texas Road House. Wisconsin reacted a little differently and the lady driving the Boxter will be in jail for a while longer. Only thing I can suggest is an upstart campaign against the D.A. and the Judge if he's an elected official. Mayb i'm a bit naive but if our local elected officials aren't toting the line elect some that will.
 
Where I live, there would have been a lot more charges. Start with this list:
Speeding more than 25 mph over limit - carries a minimum license suspension (1 year) and up to 1 year in jail.
Vehicular homicide while DUI - 5 to 15 years in jail.
Reckless driving - more points and adds to the suspension
Failure to yield - more points and adds to the suspension
Disobeying a traffic control device - more points and longer suspension.

By all rights, this guy should have been incarcerated for at least 10 years.

However, the family should at this point sue him for wrongful death. Like Fred Goldman did to OJ Simpson. Make the guy a pauper for the rest of his natural life. I know that I would sue him so hard that his grandchildren would be living in cardboard boxes under a bridge.
 
That is absolutely pathetic......The judge is probably also a drunk....They tend to sympathize with their fellow drinking buddies.....If I were the judge the offender would have been given the maximum sentence....I and my wife have driven down that same street many times...We lived just NW of Springfield from 1987-1990...
 
That's pretty bad, but it could and does get worse. There are times when someone does something as equally horrific or even much worse, it's caught on video so that there is no doubt or question of what happened or who did it, and then the defendant's attorney successfully argues to the judge that such evidence needs to be excluded because it could or would cause undo prejudice and then making it even worse, the judge issues a gag order on all of it throughout the trial so that much of the pertinent evidence is not heard by the jury, whom then acquits the defendant and then after the trial is over, finds out about the evidence that would have rightfully convicted if it had not been withheld from them.

It's a sad state of affairs anymore and no wonder that people are pretty angry across the board and from top to bottom.
