even tho iam on no spray list. ever couple yrs here they come , dont tell nobody,sprayed fence line to . were grass is maintaned..saw muscadine vine on fence my wifes favorite prducer,,sprayed that to..wild blue berries all down that power lines,,my well that i drink from 35 ft from spray area..hart emc has been trying not to cut ,ever since i let them come down the property to begin with, that they said they would maintain,,,cut only.....once or maybe twice in 15 yrs....now i have a 200 ft heirloom corn garden going right down the fence line..they had no regard of over spray..kind of hard to sell organic ,with herbicides on it. i wish i knew a lawyer that would help out the little guy...against the big guys....what about the rabbits i lke to hunt ,that eat herbicide vegatation..i cant even talk to these vultures with out going off,,, hot head..............dewy
 
Look at your property deed and there will be a power company right of way.We all want electricity but no one wants what comes with it.You can't have it both ways.Just stating the facts.Scott
 
Outrageous if you are on some kind of "no spray" list. Probably the foreman doesn't check the list.
Probably they think they're doing you a favor by spraying the fence line.

As long as you are keeping the power line area clear they should be able to bypass your property.

Maybe some large signs reminding them that it's a "no spray" area?
 
dewy, I an with Centex here... If YOU were Keeping the ROW mowed of to ground level (maintained) there would be NO Need for Them to come on your property!!! There must be something they do not like. Has it narrowed up over time? and they Widen it out, something. Figure out just what its is! and keep that from ever becoming a problem again! They must be wanting and absolute clean ROW 100 ft wide for example. Talk to the local Engineering Dept and get Their imput so they do not Ever Come Back On Your Property to spray your Wild grape and Blue berry vines. Find out if that is the problem!!
If they came on your property for a reason , Find out they require and Do Not Let those Requirements ever happen again and they want to come back on your place to...DO Maintence on the ROW!!

They brush hog our--well their line--every five years or so. Cool thing is, the mowing regenerates the grey dogwood. It used to be just grass with very little cover. Now I have an almost continuous patch of grey dogwood, elderberry and blackberry canes. rabbits love it! I leased the piece that crosses our property a few years ago. Cost $17.50 for about four acres. Gives me a little more clout when dealing with quads and snowmobiles.

Thats their rite-of-way and they paid for that when line came thru probably in the agreement theres something about keeping it clean from growth that would bother their stuff how are they going to get thru vines ect to maintain their stuff we all need their product and sometimes thy need clear access to get thre if you kept it clean from unwanted stuff they woulldnt need to spray and they will pay good for damages read the agreement and then you will see why they sprayed.
 
I feel for ya man. We have a little land 200 miles from home. There's an 80' R.O.W. for the power lines. Most of the R.O.W. on my property was old pasture that was mostly grown up with goldenrod. Another portion, mostly a ravine, was getting over grown with cedar and other trees.
The electric company hired someone to "mow and trim" (mulch) their R.O.W. No problem......except they didn't stick to their R.O.W. They mulched as much as 150' wide when their R.O.W. was only 80'. They knocked down fences, put some back up in the wrong place and left others down. They stripped dirt from some areas and filled other areas. In general they made a great big !#$%^!! mess. I tried to go down there to check on things while they were there but the contractor they hired would work in the area for a few days then be gone for months, then work in the area for a day or two, then be gone for months.

The only advice I can give you is to spend a few bucks to consult an attorney to see what rights, and recourse you have.
One of my neighbors got a several thousand dollar settlement for flowers that were killed from over spray when a farmer sprayed his crops. Maybe you have some recourse.
 
John A nailed it, that is what I have done. I pasture or crop the right-of-way ton keep it clear. They have no reason to be here except for maintenance of the line.

Sounds like they had no reason to be on the OP's property.....He said it was mowed and he's on the no spray list, yet they sprayed anyway.

ower company's hire contractors to clear the right of ways, they get paid by the mile or square yard for a set price so these contractors do what makes them the fastest buck and that could be either spray or mow or both. The power company's have no clue what these dorks did until a land owner complains and all they come up with is stupid exuses.
BTDT as i have an high voltage line going trough my pastures and these contractor A-'oles F up every time and they seem to change from one outfit to another as i never see the same outfit twice.
I put a stop to the BS by putting locked gates on each end of my property so they have to come to the yard to ask permission,which i only give if i have the time to go with them and i tell them exactly how i want things done and i charge them $50 an hr for as long as it takes.
If a contractor does not agree with me i refuse him access and notify the power company what happened and let them deal with it.
My land my rules.

Post signs, keep it maintained yourself to THEIR standards, not yours or they will make it comply. Otherwise I don't think you have much to complain about. It's life in the country.
