What would you do? Tractor sold an paid for but no show?

I sold a tractor back in October of last year and the gentalman has paid me for it and told me as soon as he done with farming he come and pickup the tractor. I heard nothing from him since then. I"ve tryed email him and sent letters to him and never gotten any answers back. I did finally get his home phone # but time all I get is just a ring and no answer. I recently I tryed it again calling him by phone and this time I getting a message that the number has been diconnected and no longer in service.

I thought of calling the local police in his area where he lives and see if they could help me out on this subject. I would drive to where he lives but it"s just over a 3 hr drive one way from me. My wife thought maybe he"s not answering my mesages do to maybe he keeping it from his wife?

I know if it was me if I bought a tractor and for sure I be going getting before now. I begining to think something has happen to him ( what I don"t know. ) Never had anything like this happen in my life time and no spring chicken.
Anyone have any ideas on how to tackle this feel free to let me know.

I would contact your local sheriff, discuss it with them, and have them contact the authorities in his area. You will have credibility that way. He might have passed away and there is an estate pending.
 
Do an internet search of his name. Maybe he passed on or is in jail. If you have his address look up a neighbor of his maybe they can help. I doubt he is hiding it from his wife.
 
That happened to a friend of mine with a 16' trailer. Guy bought it at auction for $400. Didn't come pick it up. After two YEARS, they find out the buyer had died about a month after the sale. Nobody in the buyer's family wanted it, so the seller gave it to my friend. It sat about another year, then I - in turn - got it from him (for free). I picked it up from the same spot it had sat in at the auction....
 
Looks like a good kinda problem! What is your hurry, some people just move to a different drummer. He will be there one of these days. :) Vic
 
Call the local police and ask them to check on him. You can explain to them about the tractor being sold and paid for and no response from the buyer. Hal
 
I was thinking of doing a people search an hope it would bring up a neighbor people near by but no luck on that yet.
I guess I'll just go ahead and call the local sheriff office in that area and like you said one way or another I should get an answer back on what has or hasn't happen?

You have a unique situation at hand . I"ve had a deal in the past that I sent some obsolete Funk conversion parts to a guy who was starting to remanufacture the Funk conversion parts & he needed to borrow some of the original Funk parts to use as patterns . He promised me that I"d get my parts returned plus a complete Funk conversion kit for the v8 to 8n conversion for my trusting him . He called me & said he was done with my parts & some of the remanufactured parts & would ship all items to me ASAP . That was about 10 yrs ago & I"ve yet seen anything at all . His email address is still working since I get no notice of it not being received & his phone number is still working since I get a recording to leave a message . That ordeal really upsets & sickens me . So you definitely are luckier than I am . Give the guy the benefit of doubt . Maybe he got sick & forgot or else he died . If he died , you may feel the need to return some of the money to his family . I wish you the best . God bless , Ken
 
I've got 5 or 6 things around here i've sold over the years and never saw the guy again.A 700 dollar set of weights,a 1000 dollar truck bed,a 100 dollar set of cultivators,a 150 dollar tractor part, and probably some other stuff.A lawyer told me to just sell the stuff and if the guy shows up just give him his money back.Your not bound to hold it forever.
 
If you want it gone send a certified demand letter.

State in the letter that you will start charging storage fees of $** per month on **/**/****. Allow 30 days grace period.

This will get his attention.

If he does not pick it up within the notice period, send storage invoices each month.

A similar thing happened to me several yars ago. The buyer suddenly became available after the first storage invoice (which he paid) and made arrangements to pick up the tractor before the next notice, which I waived.

Mike, you say he is 3 hrs from you. Where exactly are you and would this guy be anywhere around central MI area?? Maybe of some help if he is. Would be glad to help locate him if he is within 40 mi of Mt. Pleasant might know of him or whereabouts. RB

He be within 35 radius of Columbus OH. He must have relatives near by but i"m coming up with no phone #"s to try in that area.
Best bet, I have the local sheriffs phone # and in morning I will give them a call.
You"d think he would off told someone in his family that he has bought a tractor.

I have sold more then one thing like that and have had more then one go for over a year before picked up. Did that with a MH 30 and right now have a power steering unit for a JD 60 sold and have had the $$ for over 9 months but the guy has not showed up. It will sit here till he does show or till I know he will not show as in 3 years or so
 
I am guessing he passed on and lived alone and while trying to settle things never found out he had bought it and whoever is handling things think your emails are scam. After a while for an empty house the phone would be stopped but probably not right away.

true story,back in 1935 neighbor was moving to california to get out of the dust. he had a nearly new ford pickup and it got hot. He pulled into my grandads yard and asked if he could park it until he got set up in cal. grandad told him to park it behind the car shed. That pickup sat right there until 2000. grandad wouldnt let anyone mess with it and it simply rusted away. He swore that someone might show up one day looking for it and it didnt belong to us. dad hauled it off after grandad and grandma died for scrap iron.
 
Sure, he probably told somebody in his family about the tractor but they just said, "Oh that's nice," and promptly forgot about it. Besides, if he did pass on, the last thing his grieving family would be worried about is picking up some tractor he bought! Even less likely if he had no immediate family, and someone not intimately familiar with his affairs is dealing with the estate.
 
I have some friends down that way, plus I head to Columbus every month or so. If you want shoot me a PM and I'll see if I or somebody can stop this guys place.
