Good friend was involved in a shooting this afternoon!!!

A fellow, I did a lot of trading with in the past, shot his son this afternoon. His name is Leroy Louderback. He is 71 years old. He has been trading equipment for fifty years or more. He kind of specialized in the small Ford tractor stuff. I just talked to him a few weeks ago about some parts for the Ford 981 I have. I am starting to round up the parts I need to restore it. Leroy told me he had to run his son off. The boy, John,(he was in his forties) had gotten hooked on drugs and alcohol. Leroy and John had a pretty good Equipment sales business going there 2-5 years ago. They seemed to be doing pretty good. Leroy told me he could not trust John with any money or trades because John just blew the money. I knew John had gotten into a physical fight with Leroy earlier this year. Leroy had a restraining order against John. It seems that John went to Leroy's today higher than a kite and started fighting Leroy and Leroy shot him. It is real shame because John was Leroy and Diana's only child.

It just seems like this week is full of bad news. If any of you are from that area of South-Western Ohio let me know if there is anymore news. It is in Brown county in the town of Georgetown.
 
Does anyone know why a person that lives in one the best countries in the world, with plenty of food, water, schools, medical facilities, etc., needs to get high on drugs or booze? It can only lead to problems that we all see much too often. I'm sure we had less of these problems 50 years ago.....but what happened. There have been great innovations, discoveries, inventions that have improved and lengthened the quality of life. But some things in society have really degenerated. Its so sad.
 
Thats a shock! John cut me a pretty good deal on 4rn dry fert White air planter. Seemed like a pretty decent guy. I didnt really deal with the old man much, he was always tinkering with a old tractor. When I was working out of town i drove by there every chance I got too see if they had anything I needed. Funny how a guy in Iowa, and a guy in Kentucky, both know the same guy in Ohio!

Dont sound good for your friend, if he cant establish self defense and/or he DID NOT reply justifiably in kind (other person was using a gun?????) and if the other person was in retreat, he may end up in the slammer, the pokey, the Big House a longgggggggg while.........

There is a short blip on WXIX TV channel 19 web site in Northern Kentucky about it. There really is not any major information about what happened.

It sounds like Leroy was arrested. That is all I know now.

I would think John having a restrain order against him should give Leroy a little better chance with the law. Never know these days though.
 
BROWN COUNTY, OH (FOX19) - According to a Brown County Sheriff's Deputy, a father shot his son to death Sunday.

>The homicide happened at 6155 Conn-Geeslin Road in Pleasant Township sometime during the early afternoon.

According to the Brown County Coroner the shooting victim was shot once in the chest. He died at the scene.

Police are currently not releasing the names of those involved, but according to records the property at the address where the murder occurred is owned by Leroy and Diane Louderback. Court documents from the Brown County Clerk of Courts say that the property owner, Leroy Louderback, sued someone by the name of John Louderback, whose address is listed as 6165 Conn-Geeslin Road for domestic violence earlier in 2012
John this guy needs a good lawyer are you availible ? Hope he has some battle wounds or he is in trouble .
 
The restraining order may help a small amount perhaps, but the use of deadly force resulting in death gets very tricky to defend, it depends A LOT on the local prosecutor and his decision, he may go after it big time or let it slide ITS HIS CALL VERY FACT SENSITIVE

I dont practice any in major criminal defense, never have never will, if I were a Judge Id be a Hanging Judge, thats for younger money hungry lawyers NOT an old semi retired fart like me lol but the use of deadly force resulting in death can make for a difficult defense to say the least

It sounds like Leroy was arrested.
I would expect him to be arrested, as a matter of standard operating procedure.
At least until they sort out what happened.
It may have no bearing on right/wrong/guilt/innocence at this point.
It's a sad set of circumstances no matter how it plays out.
 
I feel for the father. If it was up to me I'd let him go. At 71 I'm sure he had good reason for doing what he did if this kind of thing happened more often maybe a few would think twice before getting messed up with that junk. My opinion of why this stuff is happening is 50 years ago people grew up in tough times had good work ethics because of it. Then things were good with the economy and people could survive much easier now things are going back the other way and most people 40 ish and younger don't know how to deal with it so they turn to drugs to make them feel better. There's tough times in my part of the world all the time and even when things are ok here I act as though there not in front of the kids because I want them to know how to survive on their own not depending on hand outs not expecting people to help them and defiantly not live off credit cards. By the time my kids move out they will ( mostly do now) know how to hunt for food, grow a garden and at least do general repairs to a vehical. Knowledge is something that can't be stolen from you.
 
It is sad, but it is also sad this post might get the axe.

I'd vote for John T. for a lifetime appointment as a 'hanging judge' but the topic might get the axe, so...I didn't say it; I wouldn't vote for it...well, if I could stand six feet away from the polling place clerk holding the Direct TV envelope addressed 'Occupant' to prove I lived at that address...no voter fraud for me,
 
Another option is that maybe he was brought in for a protective watch of sorts. It sure can't be easy shooting your own child. He has all of my sympathy and support.
 
I would believe that a pulled back fist from a 40 yr old aimed at a 71 yr old is in fact deadly force and if that was in fact the case then he had every right to even the playing field with his own deadly force. Anyone who thinks a blow to the head of a 71 yr old from a drug induced 40 yr old isn't deadly force is dillusional to say the least.
 
Just like I said on Friday after the school shooting, it will keep happening, just like you now posted, not as many loses, but a death. as Barry said tonight in newtown " this has happened 4 times since I took office"! Sad but true. It will keep happening!
 
We must pray justice is done. If the dad deseves jail,so be it,if the son needed killing,may the DA see it that way.
IMO,there are rare few cases where it's justified for someone to atack thier parent. There is far too many instances where a sorry excuse for a human go's home to administer another beating to one who has taken care of them for years but refuse to or can't forfill the aggressor's demands. They should issue permits to those who desire to intervine and give them a lesson in respect.

Let the staff get training and start carrying. When people can fight back the cowards think twice about it. When the guy in that mall last week was fighting with a jammed rifle he saw an armed shopper advancing on him and shot himself once he got it working.
 
While I agree with John T. that it is all fact sensative and up to the local prosicuter. and that right to self defence laws vary from state to state. let's look at the facts as presented so far (assuming that they hold up as correct): 1.The son had been in a fight with the father before. 2. the Father had a restraining order agianst the son that he violated. 3. he agian started to fight the father ( hope that there is physical evedence to support this). 4. he was reportedly "high as a kite", witch a blood test will quickly prove/ disprove. 5. acording to the post by Thesmoothedeere, the son was shot once in the chest, witch stands to reason he was facing the shooter. Now, if the prosicuter decides to go after this, this is still america (no matter who is in the White House), and he will need to get a jury of 12 to agree with his asertions. If these are the facts and they hold up, I think the father is not in too much leagle trouble. emonital trama and dealing with the wife's opnion is another matter.
 
My sister lives right the road from Georgetown. I'll check in with her and see what she heard.
 
I think the toxicology reports will shed a lot of light in this case. The son had a restraining order against him due to previous physical assault(s). Depending on the drug of choice, a person can have almost super human strength which allows them to invoke serious physical threat and even death. Maybe the mom was a witness?
 
That is a real sad part of this. I am willing to bet that Diana did see it all go down. She and Leroy where seldom apart when at home. They are a close couple.

I can remember meeting him over thirty years ago at sales. He was just struggling like the rest of us to make a living. Diana would be right there with him. No matter how cold or hot.

Leroy is a man that deserves respect. The son not so much. I never would deal with him. I always felt he was a little slimmy for me. Leroy could tell me something and I would take it to the bank. I have boughten a lot of equipment from him sight unseen. It was what he told me it was.

I am afraid this will be the end of him. I don't know how you can get over having to kill your son.
 
Restraining orders seldom work; almost every day there are news stories where someone has been killed or severly injured by a person with a restraining order against them. In most cases, people are not prepared to defend themselves when the restraining order doesn't work, so they suffer.

It is also not unusual for a prosecuting attorney to make a decision based on whether that person is coming up for election and needs some politicial points. About all anyone can do is pray for a just decision based on facts not political desires.

Personally, I'd send Leroy home after telling him that he has a right to defend himself when the restraing order didn't work.
 
Very sad for sure.A meth addict or crackhead needing a fix are both very dangerous and will stop at nothing to get money to buy drugs.One around my area killed his grandmother a few years ago.Home invasions are now common by these same type people.The father wouldn't be charged with anything if it was up to me.
 
I live 8 miles south of them I had seen on a local station that had happened up there, but no names had been listed at that time.
 
Lost a good friend that way.

She was at work and her drugged out boyfriend just walked in and shot her in the face. Had two little girls.

As horrible as that was, I can't even imagine the pain of shooting your own boy - Has to take something out of you, no matter how much you can justify doing it.

Leroy and my late father were friends since they were little boys. I've literally known Leroy ALL my life. He gave me my first bottle after I came home from the hospital as a newborn baby. John and I had been friends since Day 1.

I'm BEYOND saddened about John falling victim to substance abuse, which is, I believe to be, the root of this whole tragic event.

It was noted by another posting on this thread that John was "slimy", and less than honest in his dealings. Believe me, John was NOT raised that way. Having been around the Louderback family as I have, for as long as I have, I knew that Leroy always taught John, myself, and hundreds of young people through the local 4H clubs, to always do your best, and to be honest with everyone.

It's nothing but a shame...

I don't know why he would even be charged at all. Son was shot in chest instead of back, so apparently on the attack, Had a restraining order against the son, probably high on drugs, etc.

Ohio has a pretty good Castle Doctrine law that says if in your house on on your property you can use deadly force to protect yourself if you are threatened.

Seems like an over-eager prosecuting attorney to me.
