Out of State Sales Tax

I often buy Harley Davidson parts at a discount out of state and have them sent to me, (Ohio to Wisconsin). I suppose there's no honest way around paying the sales tax when filing my annual income tax??

Thank you,
Glenn F.

If you are buying on-line and the people you are buying from do not have a brick and mortar store in your state, then you do not need to pay the tax. It is the sellers responsibility to collect sales tax.

Our state tax form has a line for it.It is up to you to declare and pay your state sales tax.I sell books mail order to all 50 states and the customer is required to pay the sales tax in their home state.NH is the only state sales tax free.States use spies to catch Maine residents buying liquor in NH.Theres a sales on all booze in Maine. This spying has gone on for 50 years in MA.Same thing was done with fireworks before they became legal in maine this year.Big brother is watching you.

WRONG.I collect sales tax on book sales to Maine addresses. If I had to file monthly reports to 49 states I would quit business.Call you sales tax div in your state.

Ohio has a sales and use tax wich requires you to pay sales tax on all goods and services purchased out of state.

In ohio there are a lot of things taxable that most don't pay on.A backhoe used on a farm is taxable along with, rear blades, rotary mowers, post hole diggers,4 wheelers used on the farm, etc. If it's not used for the direct production of agriculture it's taxable.

Time to tax internet and all catalog sales.
Local merchants can't compete against net merchants they way it is now.
The federal gov need to create a sales tax jurisdiction standard based on delivery zip code. Then create and maintain a ACH based clearing house that collects all the sales tax at time of sale. Monthly remitted by ACH to local tax authorities. fed VIG would be a fraction of a percent with a max amount per month.
States get $ they need and already have authority to collect and local merchants get to compete on a level sales tax field.
think about this idea.

I could be wrong, and am most of the time when dealing with the wifey. But I don't believe internet sales are taxed in Iowa. They want to do it, but it has not happened yet. gobble Remember I could be wrong.

The federal government, as big as it has gotten, is still not as wide reaching as the internet.
I don't see how this would be within their reach.
Even if it were, they would just squander that money too.

Though the seller need not collect sales tax when selling to a buyer in another state, the buyer is still legally obligated to pay the sales tax to the state in which he resides.

Here in the Socialist Republic of Wisconsin we are required to pay a "use tax" on goods purchased through mail order or internet sales if we don't pay tax on the transaction at purchase time unless it was a transaction for goods or services that would normally be tax exempt if completed in Wisconsin. I am not required to pay the use tax if I buy it in another state, pay any taxes they levy on the transaction, take delivery and transport or arrange for transport back to Wisconsin. If I buy truck parts through E-Bay and have them shipped to me and take delivery of the parts in Wisconsin I owe use tax. But if I buy a garden tractor through E-Bay, say from a dealer in Michigan, drive to Michigan to pick it up and pay Michigan sales at purchase I do not owe any use tax. This is something that needs to be fixed as in so many states the sales tax varies from county to county and even within the county if the state allows local option taxes to governments other than county. Also other differences in sales tax codes from state to state aren't fair and too complex to enforce. Florida used to have a law requiring before you operate any motor vehicle on public roads on other than a dealer tag sales tax must be paid. Technically I shouldn't of been able to drive my Mustang on Florida roads, I was a GI, a legal resident of Michigan and purchased it from my father so it was a Michigan exempt sale (between relatives), it had a Michigan tag. Also technically when I knew I was going to be discharged and switched the tag to Florida I should of been required to pay sales tax. I would of had the same potential legal problems had I bought the car tax free while posted overseas and shipped it home. A similar problem occurred when I sold a new Mercury Sable for export, the exporter couldn't drive it to port unless he paid tax, we could deliver it to port for him on a dealer tag, but he'd forfeit any rebate and our franchise agreement with Ford Motor didn't allow us to sell new cars for export. We charged him sales tax and he applied to the state to get it back and we did a Sgt. Schultz on the export (we know nothing, nothing I tell you!)

This has been a fight that is on going between the states and federal government. Basically the states want other states to collect sale tax for them and send it to the state of the buyer. The state that collects the money wants a cut for collecting the money and sending it to the buyers state. The states of the buyers wants all the money on the basis that they will collect the taxes for the others states from in state sites and pay the other states. Problem is that some states have more or better sites to buy from so more paper work. The federal government isn't interested in it at all because of the logistical nightmare of states have different tax rates. I don't see any short term solution.

Book sales are very slow.I would have to file tax forms for 49 states monthly. You havent seen a Maine sales tax form.I would just quit the business. The sales tax people must train at the IRS.We have a tax on vegetable seeds, seed potatoes, vegetable plants, fertilizer used in home gardens. The list is endless.

Enjoy your tax-free purchases while you can. It's just a matter of time before all purchases are taxed. Either the majority of states will form reciprocal agreements to collect each others tax, or the federal government will step in and do it for them.

Information on paying Wisconsin use tax is at the link below. If you decide to pay it, you might just be the only person in Wisconsin to do so.
