I offered a man 400 for an H farmall that was torn down and motor stuck, tires bad single front,he said hed have to have more than that I offered 500 said he would get back to me in a couple weeks , well guess what after I thought about it I wouldnt give the 400. Thats were 2 fools met one for offering the money and the other for not taking the money,.
 
I went and looked at a "h" the other day that was running but was in dire need of rear tires.by the time i bought the tires i looked at then i probably have more money in it than it was really worth. Ive located a cheaper place for tires since ,and i may go back and look at it closer.
 
My take on this is somewhat different. What if the fellow comes back and says he will take the $500? If you offered to give that, and he says yes, in my book you are obligated to keep your word. If you don't, you suddenly stop becoming a fool and become something much worse. Mike
 
be careful about cheap tires. There are some china made ones out there that rot off in 2-3 years.
 
No, Gordo, Contracts 101. No consideration needed for a tort. In fact, many are downright inconsiderate! LOL
 
Nope, per contract law, offeror is free to withdraw his offer until acceptance by the offeree. The "I'll think about it" by the offeree lets our guy off the hook. But to do it right, he should call the seller and tell him he's no longer interested.
 
Its just talk until you both agree on the price, there were no contract,verbal or what ever.bs shouda woulda coulda
 
In my book "I'll think about it" is not an acceptance. It is a maybe, a maybe is the same as a refusal. You accept my offer when given, cause when I leave the offer goes with me.

If he comes back, you tell him "I made that offer yesterday. This is today. We start over".
 
Well, you are kind of stuck. An offer is an offer. Its up to him now to say YES or NO, and honorably, you to live up to your words. But, none of us is perfect, all of us made mistakes. Just ask my 52 ex-wives and their lawyers.

I always tell them,"when i leave my offer goes with me".All that thinking about it BS is to keep you on the hook while they search around for a better offer.
 
I ran in to the same thing in an online auction a year ago. The stuff was right up the road,so I put a bid on an NH3 applicator. I stopped and looked at it a few days later when I went to the bank. I thought "OH NO,I hope somebody bids against me!". I got real lucky and they did. I didn't jump back in.
