This is kinda off topic but I do own a '51 8N.

If memory serves me correctly you are a retired lawyer and I have a question.

I was in court yesterday (small village) over a traffic ticket and to make a long story short the judge flat out lied and when I inferred that my documentation showed a difference from his remarks he appeared to lose his cool and tried to bully me.

My question involves the court itself. In New York to my knowlege everyone involved in adjudicating a case is considered a court officer including the lawyers.

Are these people bound by law to telling the truth?

This is not a very serious issue and I was just looking for an opinion.

Welcome to the real world. Such things happen routinely, especially at lower level, i.e., municipal courts.

US S. Ct case case law has held that law enforcement can lie to you and they will do so regularly, and without remorse.

You will be far better off to simply knuckle under and get on with your life.

Brad, In Indiana, and likely alllllllllll jurisdictions, Attorneys, having passed the Bar and duly admitted to practice law in the state ARE OFFICERS OF THE COURT AND BOUND BY LAW TO THE TRUTH. In our state if a person has a beef with an Attorney they report it to the Indiana Supreme Court Disciplinary Commission and such reports and allegations are indeed taken seriously and investigated........

HOWEVER WELCOME TO THE REAL WORLD many of the Judges and Attorneys socialize and play golf (get the picture Im sure) and taking them on is worse then fighting city hall, been there done that got the T Shirt fought and always lost grrrrrrrrrrrrrrrrrr

Im sure in your state there is a process and an agency (Supreme Court in our State) to report problems and make allegations regarding attorney or judges mis conduct AND THATS WHERE I SUGGEST YOU FILE A FORMAL COMPLAINT problem is you can easily win the battle and loose the war grrrrrrr

DONT BLAME ME I didnt get into this racket until long after A REAL LIFE as an engineer farmer and implement and truck dealer Im NOT in the club (Nope dont play golf lol) with real attorneys Im ONLY a semi retired Country Lawyer

I know how you feel . I was in the court in Detroit Mi for a no tarp ticket. I had a good lawyer and the state law on my side. Still lost the battle a little . We had the cop lying under oath,could not tell the court what direction he was facing when he saw the truck,etc ... The judge was taking my side and his. It cost me 500$ fine 3 days no work and 1000$ for lawyer. Like you I am mad as HE!! but no where to turn. The best is found out the cops wife is a judge in the same court using her maiden name. No there's no special treatment. I NEED A BLOOD PRESSURE PILL GRRRRRRRRRRRRRR !!!!!!!!!!!
 
Each state has its own board that reviews complaints of misconduct by lawyers and judges. Here in Michigan, it's the Judicial Tenure Commission. It looks like it's the Commission on Judicial Conduct in New York.

Bear in mind, your allegations against the judge are going to be weighed by judges, former judges and lawyers. It's the only game in town, so you get to play by their rules.

I actually think in this case the judge was covering for his staff who mishandled the paperwork.

Just found it a bit amazin'. I was in the biz for 26 years and found more than a few who would 'juice up' a ticket but few and far between was one who would lie in court.

Guess that is why I am gettin' my hands dirty growing apples and not a big wheel in law enforcement.
