Tractor/Van Accident - follow up: driver arrested

I'm glad they did not waste any time going after the driver. Too bad for the operator (I think I know the business that owns it and have done business with them. I'll refrain from mentioning names because I have not heard the ownership confirmed as of yet) as it will cost them money as they will inevitably be dragged into court by lawyers looking to go after deep pockets even though they did nothing negligent. At times like this I wish our state had strict guidelines as to what could make its way into court. It probably would be worse if the victims were regular folks as their survivors would readily seek out lawyers and sue all who were involved.
My prayers go out to those killed and injured in this.
 
it was the people that use to own jd dealership in hall they still own fertilzer place across the rd, that own spray rig..its too bad...i hope this guy gets what he has coming to him..driving drunk at 12.40, he messed up alot of lives because he was stupid and in a hurry
 
42 years old and drunk in the middle of the day tells me he's a loser who has been in trouble before and has been slapped on the wrist the previous stimes. I know I'm steriotyping. This might have been the first time for a clean cut man who made a mistake but something tells me otherwise. Sure hope the owner of the sprayer isn't dragged into court too far. The court will find some small insignificant violation the sprayer driver made and it will be just enough to let the laywer who makes 40% of the proceeds, in the door. Maybe these Amish folks won't allow that, I don't know. Jim
 
My opinion: The van driver no doubt or his heirs if he is deceased,will I"m sure be looking for compensation for injuries and/or loss due to no fault death and/or property damages.The Amish however will have a forgiving out look on the accident and will not pursue recovery. If they would testify in court it would have to be under the demands to appear section of the civil court of the local juridiction.Regrettably the tractor operator and the tractor owners are in for a shock when a notice of civil suit is served upon them.My hope is that they are insured enough to cover the horrrible situation this accident has created. The car operator if he is insured at all will have legal representation up to the policies limits.I know nothing of the circumstances and am just offering my opinion for what it is worth which is not much.
 
They need to start charging people with manslaughter and making them serve consectutive sentences for stuff like this. Years ago I had to cut three young men out of a burned out Jeep on Christmas morning after they were hit heat on by a wrong way driver on the interstate. They guy that hit the had two DUI priors and a third pending when he killed those kids, drunk again. This tractor wreck will affect probably hundreds, from the families to the Fire, EMS, Police and hospital staff that had to deal with this tragedy.
 
The Amish probably won't sue but the insurance companies will and who knows with the respective vehicle drivers.
 
i would hope they dont drag owners of sprayer into this mess...they were just going down the rd..it was drunk guy in car that caused it all to happen...but i dont know the laws
 
Take accident causing car driver, borrow 4 teams of Amish horses and attach rope end to hitch, attach other end of rope to arm or leg of driver. Position one team facing east, one team facing west, one facing north and one team facing south. Tell drunk driver to pay all damages or someone will yell 'Giddyup'. 3 movie cameras to catch results could sell complete 15 minutes of resulting film for $5.95, 1/2 to Amish, other 1/2 for administrative expenses. DVD feature added to say some Saudi court cases might get a couple % of the DVD sales price. RN
 
Quite a bit has come out about the car driver's background on the news today out of Rochester, NY and I would guess that his insurance is inadequate at best.
