Lawn Mower Situation

A friend of mine purchased a mower from a man, who sells mowers in his neighborhood, for $100. Then a problem started shortly after where gas was leaking everywhere and they took it back to the man that sold it to them. They wanted to get there money back then and there, but the only thing he said he would do is fixe the problem, so they agreed to do that. The man fixed the problem and then called to let them know. My friend tried numerous times to set up a time to go pick the mower up, but nothing seemed to work out. They called the man today, and he said that he sold the mower! And his reasoning was that they didn't want the mower in the first place when they brought it back to get the leak fixed.

What would you do in this situation?

The guy basically stole the mower, and now he wont give the money back. Is there any way to get the police involved?

kind of a fishy story. people around denton ne are usually honest!
pretty cheap mower; i just paid $4800 for one to mow my place.
 
This happened in Lincoln, the guy who sells the mowers lives right across the street from Roper Elementary School, on Coddington.
 
They should go to his place of business, with two large friends, pick out a $100 dollar mower, or more, Load it up quick and drive off.

Sounds like your friend has some problems also.He buys a 100 dollar mower and expects warranty.Have you tried the local sheriff?Sounds like it's already cost more than 100 bucks of agrivation.
 
Put an add in the paper as to the jerk that he is. If that doesn t get his attention , maybe a full size farm tractor that happened to gets a little wild & runs over some equipment might set him straight. I have worked on many lawnmowers & equipment & if anyone ever got short changed it was me. I have even given some people there fixed equipment to them free because they couldn t afford the fix , but thats just me. I believe that we should help each other but some jerks don t seem to realize that they maybe in the other mans shoes someday.

There are two sides to every story. Most repair places have a policy that after 30 days the item is considered abandoned. How long was your friend's mower at the repair place?
 
sure ,,just call them . See what they say . BUT everyone is quick to judge and offer beatdowns and advice,,without hearing the other side of the story .
 
They purchased the mower last fall and soon after it develeped the gas leak, so they took it to him because he said that he would fix it free of charge. My friend said that everytime they called the guy, he would say that another mower or a snowblower was in front of it to be repaired. Once he finnaly got it done, they for some reason couldn't find a time to pick it up. Then they call the guy today and he said that he sold it.

I would just like to try and find a solution to this problem that my friend has.

For a $100.oo Id say it may not be rite or fair but he had it cumming--------------I dont think id want anything to do with eather 1 of them.
 
there has been alot of response over a 100 lawn mower it goes to show you princable over dollars maybe people are becoming humans again
 
Sounds like theft plain and simple. Of course he can get the police involved. What makes you think the police couldn't be involved? He gets the mower or his money back! The cops might come down real hard on the guy. Does he have a business license, does he have liability insurance for people coming to his place, etc. You don't have to have or do anything special in order to talk to the police. I think the police could clear the matter up pretty quick.
 
The lawnmower seller sounds like a crook but as a
practical matter if there isn't anything in writing and/or written receipts (I'm betting there isn't) it'll all be a waste of time to try to recoup their $$$$.Also you're taking your friend's word for what actually happened.No piece of paper so thin it doesn't have 2 sides.
 
The ONLY legal recourse you have is to take the guy to small claims court. Beat him up, steal one of his mowers... YOU will end up being the bad guy and YOU will end up in jail. He will still have your $100.

It just grinds my gears when people make bad purchases and aren't "man" enough to live with them. There's no reasonable expectation that that mower was sold anything but AS-IS. It's a $100 mower. Someone pushed it to the side of the road, this guy picked it up and got it running for as little as he possibly could. It's one step above scrap metal. How could anyone expect it to work like something fresh out of Home Depot?

They had the audacity to get in his face and demand their money back. As evidenced by this thread, it's not in human nature to take the high road when someone is a jerk to you. This was a FREE repair that he didn't have to offer in the first place, so he was well within his right to prioritize paying customers over the FREE repair.

The icing on the cake was not picking up the mower when it was fixed. You get in my face and demand your money back on a mower that was sold as-is, I fix it for FREE just to get you off my back, and then you don't come and pick it up? If you were in his shoes, how much would you put up with? Human nature, it's tough to not want to "get even."
 
It may sound like theft, but its not, at least as far as the police are concerned. Of course, the first day of police academy, cops are taught to yell "Its a civil matter!" as they run for the car in cases like this.

Theft is when you come and take my mower off my property. Selling something entrusted to you without permission is "conversion", and gives rise to a civil action. I suspect if he's threatened with a Small Claims action, he'll come around pretty quickly.
 
You'll have succeeded in converting a civil matter into a criminal one. But now you're going to be the criminal. A decent attorney would probably get you off, but it'll be a hassle, going to court, etc.

Cops just hate "self help"- it takes them out of the equation, and even if they aren't going to do anything to help, they want to control the situation.
