If you go from a 12.4 - 38 tire to a 16.9 - 38 tire you will pick up quite a bit of speed due to the much taller tire. Even if the big tire might float/spin (likely not) the extra speed will eat up your power and kill you very fast. If the 12.4 tires are killing the motor now, just stick with 12.4 sized tires and add 5 more lbs of air pressure. That should help you slip a little more.
